Provide the report with date and name of the appraiser. If there is no valuation yet, do not order one without consultation: first discuss what valuation is needed.

Helping someone with a gift can mean a lot. We also consider what you yourself need to retain, so you can make an informed decision.

Why do I go to the notaire for this?

A gift reduces your assets. The notaire helps assess what you can spare, which form fits best and which conditions provide protection.

Not every gift of money requires a notarial deed.

How do I gift money, investments or shares?
  1. Determine what you need to keep for yourself and what you want to give.

  2. Discuss the gift, conditions, taxes and consequences for other heirs before the transfer.

  3. Execute the chosen form correctly and keep the supporting documents.

How does this proceed and how long does it take?

There is no fixed preparation period. The tax consequences depend among other things on the form, registration, date and fiscal domicile.

Have the applicable rules checked before making the gift.

We agree on which searches the office will conduct and which information you, your bank or another expert will provide.

What should I pay attention to before I sign?

Check the amount or goods, the recipient, any return in case of earlier death and what income or control you retain. A gift already made cannot simply be revoked.

Is a passage still unclear? Feel free to ask for an explanation with an example from your own situation. Only sign when you understand what you are agreeing to.

What else must I arrange afterwards?

Keep deed or bank certificates and accompanying agreements. Monitor any conditions and registration.

Report the gift in later succession planning.

Which practical tips can help me?

Do not first make a gift and only then discuss conditions. Determine in advance what you want to protect and which form is necessary for this.
