Why do I go to the notaire for this?

A bank gift requires correct proof of transfer and associated agreements. The civil-law notary can assess what happened when, and any applicable conditions.

How do I prove a bank gift and its arrangements?
  1. Discuss in advance how the gift will be executed and evidenced.

  2. Keep bank receipts and dated communications.

  3. Have it assessed which confirmation and registration fit the gift performed.

How does this proceed and how long does it take?

The date of the actual transfer is important. A document must not contain fictitious prior arrangements or backdating.

Have the applicable tax consequences checked.

  • When and how was the actual gift made?
  • Which conditions were demonstrably agreed upon?

What should I pay attention to before I sign?

Check donor, recipient, amount, date and conditions. A supporting document is not intended to add any desired condition afterwards.

Is a passage still unclear? Feel free to ask for an explanation with an example from your own situation. Only sign when you understand what you are agreeing to.

What else must I arrange afterwards?

Keep bank receipt and confirmation together. Follow an agreed registration and include the gift in later succession planning.
