Funds that can help the next generation
The explanation dated 14 July 2026 about the transmetted gift remains relevant for those who have recently inherited. Perhaps you have sufficient reserves yourself, while your daughter wants to buy a house or your son is renovating. Then the question arises whether you can pass on part of your inheritance without paying full gift tax again.
A scheme with conditions exists in Flanders for this purpose. You accept the inheritance and then give part or all of it on to the next generation as a gift. This is a different choice than rejecting the estate. Which choice suits you requires an assessment of your own situation.
The calendar starts at the moment of death
The transmetted gift must be made by notarial deed within one year of the death. So do not count from the moment the money arrives in your account. Discuss your intention in good time, even if the administration of the estate is still ongoing.
Among other things, the Flemish inheritance tax and the tax conditions for the gift must be examined. A normal bank transfer is not sufficient to apply this specific exemption. Even for a gift of money, a notarial deed is required for this scheme.
Exemption does not automatically mean everything is tax-free
The Flemish Tax Administration clarifies the limits in position 19021 under article 2.8.6.0.9 of the Flemish Codex Fiscality. Both the inherited value involved and the inheritance tax levied on it play a role. Depending on the ratio between inheritance and gift, the exemption can be proportionally reduced.
Specific conditions about the link with the inheritance also apply to real estate. So do not assume that every gift up to the amount of your inheritance is fully exempt. Have the concrete calculation made before you definitively promise amounts or goods.

Example: a parent inherits money and wants to support a child with a purchase. First clarify how much the parent wants to keep for housing, care and unexpected expenses. Then discuss the amount available for a gift.
